1. About these terms

These terms and conditions (the “Terms”) govern your use of the website at themeparks.co.uk (the “Site”). By accessing or using the Site you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

3. Using the website

The Site is provided for your personal, non-commercial use to read content about UK and global theme parks. When using the Site, you agree:

• not to use the Site in any unlawful or fraudulent way;
• not to attempt to gain unauthorised access to the Site, the servers it runs on, or any connected systems;
• not to introduce any viruses, malware or other harmful material;
• not to scrape, mirror or systematically extract content without our prior written permission;
• not to use automated systems (bots, crawlers) in a way that places an unreasonable load on our infrastructure;
• to comply with all applicable laws and regulations when interacting with the Site.

4. Accounts & user content

You may be able to create an account, leave comments, write reviews, or submit other content (“User Content”). If you do:

• You are responsible for keeping your login credentials secure and for all activity under your account.
• You confirm that any User Content you submit is your own (or that you have permission to share it) and that it does not infringe anyone else’s rights or break any law.
• You must not post content that is unlawful, defamatory, obscene, harassing, hateful, misleading or that infringes privacy or intellectual property rights.
• You grant us a worldwide, non-exclusive, royalty-free, perpetual licence to host, store, display, reproduce and publish your User Content on the Site and in related marketing.
• We may remove or edit User Content at our discretion, for example if we believe it breaches these Terms.

5. Intellectual property

Unless otherwise indicated, all content on the Site — including text, graphics, logos, photography, video, code and the “themeparks.co.uk” brand — is owned by or licensed to O&J Studio Ltd. and is protected by UK and international copyright, trade mark and other intellectual property laws.

You may view, download and print pages of the Site for your own personal, non-commercial use. You may not otherwise copy, republish, sell, sublicense, modify or commercially exploit any content without our prior written permission.

Park names, logos and ride trademarks belong to their respective owners and are used for editorial purposes only.

6. Affiliate links & offers

The Site contains affiliate links. If you click an offer or “Get tickets” link and complete a booking with the relevant operator, we may earn a commission at no extra cost to you. Affiliate links are typically routed through networks such as Awin or Partnerize. See our Privacy Policy for how click data is processed.

Prices, availability, opening times and terms shown on the Site are indicative only. The contract for any tickets, bookings, hotels or experiences is always between you and the relevant operator. We are not the seller, agent or guarantor and we do not receive payment from you for the underlying booking.

7. Third-party sites & operators

The Site links to third-party websites, including park operators such as Disney, Merlin Entertainments, Universal, Europa-Park, PortAventura and others, as well as ticket resellers and travel providers. We do not control these sites and are not responsible for their content, products, terms or privacy practices. Your use of any third-party site is at your own risk and subject to that site’s own terms.

8. Accuracy of information

We work hard to keep the Site accurate and up to date, but theme park information — including ride heights, opening times, prices, closures and event dates — can change without notice. Always check the official park website and booking conditions before travelling. We do not guarantee that content on the Site is current, complete or error-free.

9. Disclaimer of warranties

The Site is provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all conditions, warranties, representations and other terms which might otherwise apply to the Site or any content on it, whether express or implied, including any implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement and accuracy.

We do not guarantee that the Site will be secure, free from bugs or viruses, or available without interruption.

10. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited.

Subject to that, we will not be liable to you for:

• any loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, or any indirect or consequential loss;

• any loss or damage arising from your reliance on content on the Site;
• any loss or damage arising from a transaction you enter into with a third-party operator linked to from the Site.

Where you use the Site as a consumer, this clause does not affect your statutory rights.

You agree to indemnify and hold harmless O&J Studio Ltd., its directors, employees and agents from and against any claim, loss, damage, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or any User Content you submit.

We may suspend, withdraw, discontinue or change all or any part of the Site without notice. We may also restrict or terminate your access to the Site or any account if we believe you have breached these Terms or applicable law.

We may revise these Terms at any time by updating this page. The “Last updated” date at the top reflects the current version. Your continued use of the Site after a change takes effect means you accept the revised Terms.

14. Governing law & jurisdiction

These Terms, their subject matter and their formation are governed by the laws of Scotland. You and we both agree to the exclusive jurisdiction of the Scottish courts, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in the courts of your home jurisdiction.
